1. Acceptance of Terms

By installing, accessing, or using Copper Sun Brass ("Service", "Software", "Brass"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Copper Sun Brass is provided by Copper Sun Content and Creative, LLC ("Company", "we", "us", "our").

2. Description of Service

Copper Sun Brass is an AI-powered development intelligence tool that provides:

Code Analysis: Pattern detection, security assessment, and quality recommendations
Project Intelligence: Persistent context across development sessions
AI Integration: Enhancement for AI coding assistants like Claude Code
Development Insights: Strategic recommendations and technical guidance

The Service operates primarily on your local machine with optional cloud-based AI analysis.

3. License and Usage Rights

3.1 License Grant

Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable license to use Copper Sun Brass.

3.2 License Types

Trial License: 15-day evaluation period with full functionality
Individual License: Single developer use ($15/month)
Team License: Team use (contact for pricing)
Enterprise License: Custom terms and pricing

3.3 License Restrictions

You may not:

Distribute, sublicense, rent, lease, or lend the Software
Reverse engineer, decompile, or disassemble the Software
Remove or alter proprietary notices
Use the Service without a valid license
Share license keys or accounts

4. Subscription and Billing

4.1 Subscription Plans

Copper Sun Brass is offered as a subscription service with monthly billing cycles.

4.2 Payment Processing

Payments are processed through LemonSqueezy, our third-party payment processor. By subscribing, you agree to LemonSqueezy's terms of service.

4.3 Billing Terms

Subscriptions automatically renew monthly unless cancelled
Payment is due in advance for each billing period
No refunds for partial months of service, except within 7 days of initial purchase or in cases of service failure
Price changes require 30 days advance notice

4.4 Trial Period

New users receive a 15-day free trial with full access to all features. No payment information required for trial activation.

4.5 Cancellation

You may cancel your subscription at any time. Service continues until the end of your current billing period.

5. Account Management

5.1 License Activation

You are responsible for:

Protecting your license key
Using the Service only on authorized devices
Promptly reporting any unauthorized use

5.2 API Key Management

The Service requires a Claude API key for AI functionality. You are responsible for:

Obtaining and maintaining your Claude API key
Complying with Anthropic's terms of service
Protecting your API key from unauthorized access
Any costs associated with Claude API usage

6. Data and Privacy

6.1 Local Data Storage

Copper Sun Brass primarily stores data locally on your machine in:

~/.brass/ directory (global configuration)
.brass/ directories in your projects (project-specific data)

6.2 External API Usage

The Service may send data to external APIs for analysis:

Claude API: Code snippets (≤500 characters) for analysis and recommendations
LemonSqueezy: License validation data only

6.3 Privacy Commitment

We do not:

Collect analytics or telemetry data
Store your code on our servers
Share your data with third parties (except as disclosed above)
Track your usage or behavior

7. User Responsibilities

7.1 Lawful Use

You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations.

7.2 Code Analysis

You are responsible for:

Ensuring you have rights to analyze code with the Service
Reviewing and validating all AI-generated recommendations
Making your own decisions about code changes and implementations

7.3 Security

You must:

Protect your license keys and API keys
Use the Service in secure environments
Report security vulnerabilities responsibly

8. Service Availability

8.1 Uptime

We strive to maintain high service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to factors beyond our control.

8.2 Support

We provide:

Documentation and user guides
Email support for technical issues
Community support through GitHub discussions

Support is provided during business hours (Monday-Friday, 9 AM - 5 PM Pacific Time).

8.3 Updates

We may update the Software to add features, fix bugs, or improve performance. Updates are provided at no additional cost to active subscribers.

9. Intellectual Property

9.1 Our Rights

Copper Sun Brass, including all intellectual property rights, is owned by Copper Sun Content and Creative, LLC. These Terms do not grant you any ownership rights in the Service.

9.2 Your Rights

You retain all rights to your code and project data. We claim no ownership over your content.

9.3 AI-Generated Content

Recommendations and analysis generated by the Service are provided for your use, but we make no warranties about their accuracy or suitability.

10. Disclaimers and Limitations

10.1 Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 AI Limitations

AI-generated recommendations are suggestions only. You are responsible for:

Reviewing all recommendations before implementation
Testing code changes in appropriate environments
Ensuring recommendations meet your specific requirements

10.3 Third-Party Services

We are not responsible for the availability, accuracy, or performance of third-party services (Claude API, LemonSqueezy) integrated with our Service.

11. Limitation of Liability

IN NO EVENT SHALL COPPER SUN CONTENT AND CREATIVE, LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Copper Sun Content and Creative, LLC from any claims, damages, or expenses arising from your material breach of these Terms, willful misconduct, or violation of applicable laws in your use of the Service.

13. Termination

13.1 Termination by You

You may terminate your subscription at any time by cancelling through your account or contacting support.

13.2 Termination by Us

We may terminate your access to the Service for:

Material violation of these Terms (with 7 days notice except for severe violations)
Non-payment of fees (after 30 days past due)
Illegal use of the Service as determined by applicable law
Activities that pose security risks to other users or our systems

13.3 Effect of Termination

Upon termination:

Your license to use the Service ends immediately
You may continue to access locally stored data
We are not obligated to maintain or return your data

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

15. Governing Law and Export Controls

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Export Controls: The Service and Software may be subject to U.S. export control laws and regulations. You agree to comply with all applicable export laws and not to export, re-export, or transfer the Software to any prohibited country, entity, or person without proper authorization.
